Terms and Conditions

1. Scope of application

The following terms and conditions apply to all orders placed via our website (https://only5left.com/) by consumers. A consumer is any natural person who enters into a legal transaction for purposes that are primarily for personal, family, or household needs and predominantly outside his trade, business or profession.

2. Contractual partner, conclusion of contract

The purchase contract is concluded with “only5left”.

By clicking on the order button, and after given consent, you submit a binding offer for the product you have selected. Confirmation of receipt of your order will be sent by e-mail after the order has been sent.

We accept your order by carrying out the payment transaction through our service provider or the selected payment service provider. The time of execution of the payment transaction depends on the selected payment method. 

3. Subject matter of the contract

3.1 Product description

This website (https://only5left.com/) offers authentic and genuine fine art prints (the “Print”) produced directly from original artworks by the artist Hernani M. The Print is produced strictly in accordance with the Edition Particulars detailed on the attached Authenticity Certificate, signed by the artist.

The product description presented on the website is an integral part of the contract.

Please note: The presentation of the products in this website does not constitute a legally binding offer, but only a non-binding online collection/catalogue.

3.2 Right of use

Sole copyright of the original artwork and the authentic fine art print (the “Print”) are retained by the artist. The artist provides a license to the owner of the Print for their own display and enjoyment. The owner of the Print may not copy or display it in any other format other than the Print without the express written permission of the artist. The owner of the print may sell or gift the print to another party and the licence and restriction shall apply to such party.

Any sketches, drafts, preliminary products, etc. created by us to fulfil the order are legally protected.

3.3 Selection of the service provider

We shall provide the service at our discretion either in our own person or by qualified personnel selected by us. We expressly reserve the right to have services performed by third parties (subcontractors) who work on our behalf. If and insofar as third parties are used to provide services, we shall remain fully responsible for the performance of the contractual obligations. Before engaging third parties, we shall check their reliability, suitability, experience and/or ability to provide the contractual services and shall oblige them to do so.

4. Terms of Payments and Liability

For payments this website uses the WP-Simple Pay plug-in powered by Stripe. This is essential for the completion of a purchase, being used in accordance with the applicable legal terms and with the consumer given agreement.

5. Terms of Shipping

5.1 Shipping information

We provide information on shipping costs and delivery dates in the order overview before the order is completed.

5.2 Shipping outside EU

We deliver for free within the EU. Other destinations possible upon expressed agreement between parts, as shipping or other fees may apply. For further questions, please contact us at: contact@only5left.com.

Please note: When ordering prints for delivery outside the EU, import duties and other taxes may be levied once the package reaches the specified destination. Any additional charges for customs clearance are consumer responsibility. only5left has no influence on these fees.

5.3 Shipping options and address

We will send the products to the delivery address specified in the order process and within the delivery period specified in the order overview for the respective product.

We do not deliver to PO boxes or any other self-service delivery locations.

5.4 Right not to deliver

In the event of non-availability of the ordered goods for which only5left is not responsible as a result of late or incorrect delivery by a supplier despite a delivery contract concluded by only5left with the supplier for the ordered goods, we reserve the right not to deliver. In this case, we will immediately inform the customer that the ordered goods are not available and will immediately refund any payments already received.

6. Return & Refund Policy

only5left offers a 30-day return window on all prints -more than the EU mandatory 14 days- because we want you to fully experience the artwork before deciding.

06.1 Right of Withdrawal

You have the right to withdraw from this contract within thirty (30) days without giving any reason. The withdrawal period expires after 30 days from the date of delivery.

To exercise your right of withdrawal, you must inform us:

You may use any clear statement (a letter sent by post or an email).

To meet the withdrawal deadline, it is sufficient that you send your communication before the 30-day period has expired.

6.2 Effects of withdrawal

If you withdraw from this contract, we will refund all payments received from you, without undue delay and not later than 14 days from the day on which we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.

We will use the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur in any fees as a result of such reimbursement.

You shall send back the goods to us without undue delay and in any event not later than 14 days from the day on which you communicated your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired.

6.3 Return shipping costs

You will bear the cost of returning the goods. The forward (initial) shipping cost is borne by us (within the EU); the return shipping is the customer’s responsibility.

6.4 Condition of returned goods

Items must be returned in undamaged condition with the original protective packaging where possible.

6.5 Damaged or defective items

If your print arrives damaged, please contact us within 72 hours of delivery with clear photos of the damage and the packaging at contact@only5left.com. We will arrange a replacement or refund without undue delay and not later than 14 days from the day on which we have received the damaged goods back, or until you have supplied evidence of having sent them, whichever is the earliest. You will bear the cost of returning the damaged goods.

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following: due to individual screen configurations (e.g. resolution and brightness), deviations between the displayed and the actual product colours are possible.

9. Bulk Purchases

At this point, https://only5left.com/ only enables single print purchase at a time. For purchases of multiple prints, and related questions, please contact us directly at contact@only5left.com.
